1. Application
These terms apply to Fire Assurance Ltd quotations and services unless different terms are expressly agreed in writing. The quotation, agreed scope and any written variations form part of the contract. If there is a conflict, a specifically agreed written quotation or variation takes priority for that particular instruction.
2. Our services
Fire Assurance Ltd provides fire-door inspection and related compliance-support services within the scope stated in the quotation. An inspection records the observable condition of items within the agreed scope at the time of attendance. Unless expressly included, our service is not a fire risk assessment, destructive investigation, design certification, installation approval, guarantee of future performance, or confirmation that an entire building complies with every applicable fire-safety requirement.
3. Quotations and acceptance
A quotation is based on the information supplied to us and remains subject to its stated validity period. Acceptance may be through the acceptance method provided with the quotation, a purchase order, or another written instruction that we accept. We may require clarification or revised pricing before confirming attendance where the actual requirement differs from the enquiry.
4. Client information and access
The client is responsible for providing accurate site information, door quantities where known, access requirements, site rules, parking arrangements, permits, induction requirements and any known hazards or restrictions. Safe and reasonable access must be available to the agreed inspection areas at the arranged time.
5. Changes in quantities or scope
Pricing may be adjusted where the number of doors, buildings, floors, sites or other items differs materially from the information used for the quotation, whether the quantity increases or decreases. Any additional or omitted work will be dealt with reasonably having regard to the quoted basis, attendance costs and work actually required.
6. Failed or restricted access
If agreed areas or doors cannot be accessed, are obstructed, occupied, locked or otherwise unavailable, we may record them as not inspected and may charge for additional attendance, waiting time or a return visit where reasonably incurred. Where practicable we will explain the position before carrying out material additional work.
7. Additional travel and consequential attendance costs
Unless specifically included in the quotation, reasonable parking charges, tolls, bridge charges, congestion or clean-air charges, permits and other site-specific travel or access costs not disclosed when the quotation was prepared may be added to the final charge. Accommodation or exceptional travel costs will not be incurred and charged without prior agreement where reasonably practicable.
8. Inspection limitations
Inspections are normally visual and non-destructive unless the quotation expressly states otherwise. Concealed construction, inaccessible components, certification not supplied to us, and defects that cannot reasonably be identified during the agreed inspection may fall outside the scope. Findings reflect the condition and information available at the inspection date.
9. Reports and recommendations
Reports, registers, photographs and recommendations are prepared for the commissioning client and the stated purpose. Recommendations identify matters requiring attention or further consideration; they are not a substitute for competent remedial design, installation or specialist advice where that is required. Reports should be read as a whole and not selectively reproduced in a misleading way.
10. Client responsibilities after inspection
The client remains responsible for deciding and implementing appropriate remedial action, maintaining fire-safety arrangements, keeping relevant records and obtaining specialist advice where necessary. Our inspection does not transfer statutory duties held by the Responsible Person, Accountable Person, building owner, employer, landlord or other dutyholder.
11. Fees, invoicing and payment
Fees, VAT treatment (where applicable), payment terms and any deposit or staged-payment requirements will be stated in the quotation or invoice. We reserve the right to suspend further work where undisputed sums are overdue, subject to applicable law and any written agreement.
12. Cancellation and rearrangement
Please give as much notice as possible if attendance needs to be changed. Where late cancellation, aborted attendance, booked travel or committed third-party costs cause Fire Assurance Ltd a reasonable loss, we may charge those costs to the extent permitted by law and the agreed quotation.
13. Liability
Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence or for fraud. Subject to that, our responsibility relates to the services and scope we have expressly agreed. These terms do not create a warranty for matters outside that scope or for changes occurring after inspection.
14. Intellectual property and use of reports
Fire Assurance Ltd retains copyright in its report formats, website content, templates and original materials unless otherwise agreed. The commissioning client may use the final report for the property, compliance and management purposes for which it was supplied. Our branding, templates or website content must not be copied or republished as another organisation’s work.
15. Third-party links
Links to GOV.UK, legislation or other external resources are provided for convenience and reference. Fire Assurance Ltd does not control third-party websites and is not responsible for their availability or content.
16. Governing law
Unless mandatory law requires otherwise, these terms and any dispute arising from them are governed by the law of England and Wales and are subject to the jurisdiction of the courts of England and Wales.
